释义	結婚的行為能力 The ability to enter into a marriage. The capacity of the parties to marry is governed by the law of the place of the ante nupital domicile of the parties: Ong Constantino Erminda v Chau Shui Hing (No 1) [1989] 1 HKC 237 (HC). In Hong Kong, a person below the age of 16, or a person of or over 16 and under 21 who has not obtained a written consent from his parents or guardian, is incapable of entering into a valid marriage: Marriage Ordinance (Cap 181) ss 13, 27(2). Since 7 October 1971, marriages entered into in Hong Kong are to be monogamous. A man is thus incapable of taking any concubines as from that date, but the status and rights of a concubine taken before that date is not affected: Marriage Reform Ordinance (Cap 178) ss 4, 5. See also Formalities of marriage. 締結婚姻的能力。當事人結婚的行為能力，受當事人婚前居籍地的法律所規限：Ong Constantino Erminda v Chau Shui Hing (No 1) [1989] 1 HKC 237（高等法院）。在香港，未足16歲的人士或未得父母或監護人書面同意而年齡超過16歲但未足21歲的人士，沒有締結有效婚姻的行為能力：《婚姻條例》（第181章）第13及27(2)條。自1971年10月7日起，在香港締結的婚姻必須屬一夫一妻制。因此，任何人自該日起都不能夠納妾，但在該日之前獲納娶為妾侍者的地位和權利則不受影響：《婚姻制度改革條例》（第178章）第4及5條。另見 Formalities of marriage。
