| 释义 | 故意拒絕圓房 A settled and definite intention of a married person not to engage in sexual intercourse with the marriage partner at all: Horton v Horton [1947] 2 All ER 871. There may be wilful refusal even if the reason for the refusal is inability to consummate: S v S (otherwise C) [1956] P 1, [1954] 3 All ER 736. A marriage is voidable if it has not been consummated owing to the wilful refusal of the respondent of the petition for divorce to consummate it: Matrimonial Causes Ordinance (Cap 179) s 20(2)(b); C v C [1971] HKLR 5. In order to determine whether there has been refusal regard must be had to the whole history of the marriage: CCCY v CWL [1980] HKC 522. The number of refused proposals for consummation required to establish wilful refusal varies with the circumstances of each case: Morgan v Morgan [1949] WN 250 (CA). Wilful refusal must have persisted to the date of the presentation of the petition for divorce: S v S (otherwise C), supra. The burden of proving affirmatively that the marriage has not been consummated is on the petitioner: Harthan v Harthan [1948] 2 All ER 639 (CA).
