An interrogatory administered without sufficient grounds and for the purpose of causing trouble or annoyance. What is vexatious depends not so much on the interrogatory itself as on the nature and state of the action and its ripeness for discovery. It would be unreasonable and vexatious if it is obvious that there is no occasion to interrogate where the fact in question had been admitted on the pleadings or otherwise. Interrogatories that are unreasonably or vexatiously exhibited will be set aside: Clarke v Bennett (1884) 32 WR 550. There may be interrogatories which in form are unobjectionable, but which in the light of the circumstances of the particular case it may be unreasonable or vexatious to exhibit: Oppenheim & Co v Sheffield [1893] 1 QB 5 (CA).
