释义 | 分劃 The destruction of the unity of possession. It occurs where the co-owned property, whether held jointly or in common, is physically divided between co-owners so that each co-owner becomes a sole owner of part of the property: Nield, Hong Kong Land Law (2nd Ed, Longman) ch 10 pp 258-9. Division of land, tenements to and hereditament’s belonging to co-owners and the allotment among them of the parts so as to put an end to community of ownership and to community of ownership between some or all of them: Halsbury’s Laws of Hong Kong, Vol 17, Land [230.0817]. Partition may occur by agreement if all parties are sui juris or have power conferred on them by law or by act of a predecessor in title. To be effective at law the partition agreement must be made by deed: Conveyancing and Property Ordinance (Cap 219) s 4(1). In default of agreement any co-owner can commence a partition action and the court could order a partition or could order a sale of the land in lieu of partition under the Partition Ordinance (Cap 352): Halsbury’s Laws of Hong Kong, Vol 17, Land [230.0821]. The court, when deciding what order is appropriate, can direct enquiries to be taken. However, these enquiries must be directed before and not at the time the order is made for the power springs from the court’s inherent jurisdiction and not from the Ordinance itself: Riseway Investment Ltd v Wong Kwok Chiang & Anor [1995] 2 HKC 25.
