释义 | 誘姦 1. The act of seducing, enticing, persuading, or eliciting another to enter sexual relations. Seduction of servants may allow a person to bring an action per quod servitum amisit (by reason of which her services were lost). In Hong Kong, the actions in tort for depriving a husband of the services or society of his wife, depriving a parent of the services of a child, depriving a person of the services of his female servant by seducing her have been abolished: Law Amendment and Reform (Consolidation) Ordinance (Cap 23) s 20B. On the death of any person after 26 October 1951, causes of action for seduction or for inducing one spouse to leave or remain apart from the other shall not survive against, or, as the case may be, for the benefit of, his estate: s 20(1). Whenever the Director of Social Welfare has reason to believe that any child or juvenile is likely to be exposed to any danger of seduction or prostitution he may inquire into the case and may make any order (including if he thinks fit an order for removal to and detention in a place of refuge, hospital or such other place as he may consider appropriate) regarding the control and custody of the person endangered which he thinks desirable in the interest of that person: Protection of Children and Juveniles Ordinance (Cap 213) s 35(1). 2. To illicit mutiny or disaffection. It is an offence for any person who knowingly attempts to seduce any member of forces of the Central People’s Government of the People’s Republic of China from his duty and allegiance to the Central People’s Government of the People’s Republic of China; and knowingly attempts to seduce any member of forces of the Central People’s Government of the People’s Republic of China, any member of the Government Flying Service, any police officer, or any member of the Hong Kong Auxiliary Police Force, from his duty or allegiance to the Central People’s Government of the People’s Republic of China: Crimes Ordinance (Cap 200) ss 6, 7(1); Interpretation and General Clauses Ordinance (Cap 1) sch 8(1), (5).
