| 释义 | 上訴通知書 The commencement of the process to appeal to a higher court against a judgment or order given in a lower court: Burgess v Stafford Hotel Ltd [1990] 3 All ER 222. Such notice must set out the decision appealed against, the grounds of appeal and the precise form of the order sought by the appellant: The Rules of the High Court (Cap 4A) O 59 r 3(2). It must be served on all parties to the proceedings in the court below who are directly affected by the appeal: O 59 r 3(5). The Court of Appeal has an inherent power to strike out a Notice of Appeal which raises no arguable point and is consequently an abuse of process: Swordland Ltd v Wharf Properties Ltd [1994] 2 HKC 223. Where the notice of appeal had been served after the order appealed from had been sealed, the appellant was required, within seven days of service of the notice of appeal, to lodge with the Registrar two copies of the notice of appeal duly endorsed and a copy of the order appealed from: O 59 r 5(1). Once these documents had been lodged with the Registrar, it was the Registrar who must file the notice of appeal and cause the appeal to be set down: O 59 r 5(2). Within four days of the Registrar causing the appeal to be set down, the appellant must give notice to that effect to all the parties on whom the notice of appeal was served: O 59 r 5(4); China Weal Ltd v Lam Sau Wah [2000] 4 HKC 227 (CA).
