| 释义 | 領土司法管轄權 1. In international law, the competence of a state over all components within its defined territory. No state may lawfully ‘exercise its power in any form in the territory of another state’: Lotus case (France v Turkey) 1927 PCIJ SER A No 10. It is a basic attribute of state sovereignty, deriving from the status of a state as an international legal person. The territorial jurisdiction of a state is free from interference by the United Nations: (Charter of the United Nations 1945 art 2 para 7), except for enforcement measures under Chapter VII of the Charter. 2. In relation to the jurisdiction of the courts in Hong Kong in criminal cases, only conduct which is a criminal offence against the law of Hong Kong and occurs within the territorial limits of Hong Kong may be tried in the courts of Hong Kong: R v Oliphant [1905] 2 KB 67 (CCR).
