释义 | 母親 The woman who is carrying or has carried a child as a result of the placing in her of an embryo or of sperm and eggs, and no other woman, is to be regarded as the mother of the child: Parent and Child Ordinance (Cap 429) s 9(1). Where by virtue of this provision, a person is to be regarded as the mother of a child, that person is to be regarded in law as the mother of the child for all purposes: s 11(1). Motherhood is now based on gestation and it is not dependant on one’s martial status or genetic connection with the child: Halsbury’s Laws of Hong Kong, Vol 12, Family Law [180.311].
