释义	不能作出裁決的陪審團 Colloquially, a jury that cannot agree upon a verdict. In such a case, the judge may discharge the jury if there is no real prospect of them reaching a verdict: R v Tam ChiPang & Ors [1986] HKLR 1122 (CA). Where the judge concludes that the jury are unable to reach a verdict, either unanimously or by a permitted majority he must discharge them from reaching a verdict: Jury Ordinance (Cap 3) s 27. Once the jury is discharged in this manner, the court must empanel a new jury, have the jury sworn, and charged with any person accused. The action, suit, information or indictment is then tried as if such first jury had not been empanelled: Halsbury’s Laws of Hong Kong, Vol 9, Criminal Law and Procedure [130.813].
