释义 | 法律擬制 An assumption in law that does not necessarily reflect the facts and cannot be rebutted by law. For example, the doctrine of lost modern grant is a legal fiction, because it presumes that an easement was expressly granted to the owner of the dominant tenement by the servient tenement owner in a deed made after 1189, and the grantee had been long enjoyed the grant.
