释义 | 使用暴力的程度 In criminal law, the amount or level of force used in committing a crime. The degree of force applied in self-defence is that which is reasonably necessary: Palmer v R [1971] AC 814; R v McInnes [1971] 3 All ER 395, 55 Cr App Rep 551 (CA); R v Cheung Kwok Wai (CACC 271/96, unreported). The test is not purely objective and account is taken of the state of mind of the accused, the jury must consider whether the accused actually believed that he was in danger and compelled to act in the manner that he did and whether in all circumstances that was reasonable: Palmer v R, supra; R v Chan Ming [1975] HKLR 666; R v Man Wai Keung [1992] 1 HKCLR 89 (CA); R v Leung Yuet Man [1991] 1 HKLR 300 (CA); Cmr of Police v Coroner of Hong Kong [1997] HKLRD 509.
