| 释义 | 無主財物 Lat – unclaimed goods; property that has no owner: Dyke v Walford (1846) 13 ER 557, 5 Woo PCC 434. Constitutional law - Unclaimed goods. The Government of the Hong Kong SAR may claim ownership of goods having no apparent title. Bona vacantia, for example, applies to shipwrecks and treasure troves. See also Treasure trove. Corporations - All property and rights whatsoever vested in or held on trust for the company immediately before its dissolution are deemed to be bona vacantia and belong to the government: Companies Ordinance (Cap 32) s 292; Wong Shuk Ying & Anor v A-G [1987] 2 HKC 457 (HC); Incorporated owners of Cheong Wang & Cheong Wai Mansion v HKSAR [2001] 1 HKC 57. Personal property - Unclaimed goods; goods the legal ownership of which cannot be determined. A deceased estate without any heir. See also Heirs. Succession - The goods of a person who dies intestate without next of kin. In default of any person taking an absolute interest under the Intestates’ Estates Ordinance (Cap 73) s 4, the property shall, subject to the Inheritance (Provision for Family and Dependants) Ordinance (Cap 481), belong to the government as bona vacantia.
