| 释义 | 同源罪行 An offence similar to another offence in that both offences have one or more common elements or ingredients so that one offence is a constituent of the other offence. For instance, the offence of robbery does not contain within itself the ingredients of the offence of handling. It follows that at common law, handling stolen goods cannot be an alternative charge to robbery, since it is not a cognate offence: R v Tsang Yat Lui [1983] 1 HKC 88 (CA).
