释义 | 所有權的移交 The transfer of property in the subject matter of a transaction from the transferor to the transferee. The basic common law rule with respect to gifts of personal property, in the absence of a deed of gift or a trust, is that title passes when possession is given with the donor’s intention. In a sale of personal property, the property in them is transferred to the buyer at such time as the parties to the contract intend it to be transferred: Sale of Goods Ordinance (Cap 26) s 19(1). Pursuant to a deed, legal title passes when the deed is delivered and is referred to as an assignment or conveyance. Equitable title to property can pass separately and usually does. Equitable interest in land must be created or disposed of in writing signed by the person creating or disposing of the same, or by his agent, or by will, or by operation of law: Conveyance and Property Ordinance (Cap 219) s 5(1)(a). With respect to gift, a form of equitable title arises when the donor need to do nothing more to complete the gift: Re Rose v Inland Revenue Cmrs [1952] Ch 499, 1 All ER 1217 (CA). With specific reference to land, when the donor delivers the relevant deed to another person in the case of general land law: Macedo v Stroud [1922] 2 AC 330 (PC).
