1. Evidence which is capable of directly proving a fact in issue without requiring the drawing of inferences from indirect items of proof. Direct evidence usually comes in the form of a witness’ testimony of directly perceived events. For example, the testimony of an eye-witness to an assault is direct evidence of the actus reus of the offence. Direct evidence is contrasted with circumstantial evidence from which inferences may be drawn in order to prove facts. For example, mens rea of offences often require the drawing of inferences from circumstantial evidence. Despite the terminology, circumstantial evidence is not treated as less probative than direct evidence: McGreevy v DPP [1973] 1 All ER 503, 1 WLR 276 (HL). 2. An antonym of hearsay evidence which is essentially evidence given in court by a witness of a statement made by a person who is not testifying in court.
