| 释义 | 反要求 A demand made by a party in answer to and against the other party who made the original demand. A cross-demand has a wider ambit than a set-off or counterclaim. A cross demand does not need to have any connection with the cause of action out of which the judgment debt arose: Re GEB [1903] 2 KB 340; Re a Debtor [1914] 3 KB 726. A debtor may apply to the court for an order to set aside the statutory demand by satisfying the court that the debtor has a counterclaim, set-off, or cross demand which equals to or exceeds the amount of the debt or debts specified in the statutory demand: Bankruptcy Rules (Cap 6A) r 48(5). In a family proceedings, to recover chattels held by the wife was held to be a cross demand justifying the setting aside of a notice issued by his wife on a money judgement: WFM Motors Pty Ltd v Malcolm Maydwell (HCMP 1405/94, unreported).
