释义 | 刑事疏忽 Negligence which, in the opinion of a jury, goes beyond a mere matter of compensation between subjects and shows such disregard for the life and safety of others as to amount to a crime against the state and conduct deserving punishment: R v Bateman [1925] 19 Cr App Rep 8. Simple lack of care such as will constitute civil liability is not enough. In fact, this standard is rare in indictable offences, but it occurs in the common law offence of manslaughter, but punishable by the Offences Against the Person Ordinance (Cap 212) s 7. The offence of manslaughter which can be committed with the mens rea of ‘gross negligence’: R v Adomako [1995] 1 AC 171 (HL). A very high degree of negligence is required to be established such that practically all the epithets of ‘recklessness’ would cover the case: Andrews v DPP [1937] 2 All ER 552, AC 576.
