释义 | 刑事訴訟程序 Proceedings concerned with peace, order, well-being of society as a whole and the punishment of offenders and the deterrence of others: Mogul SS Co v McGregor, Gow & Co (1889) 23 QBD 598. ‘Criminal proceedings’ and ‘criminal matter’ are wide terms and must be given their ordinary meaning, they are used interchangeable and in effect there is no difference between them: Crown Solicitor v Datuk Dr Jeffrey Kitingan [1994] 1 HKC 516; (1994) 4 HKPLR 860. Criminal proceedings may not be used to enforce a right at civil law: R v Peel [1943] 2 All ER 99 (CCA); R v Master (1869) LR 4 QB 285. The primary responsibility for institution and continuance of criminal proceedings lies with the Secretary for Justice as head of the Department of Justice: Criminal Procedure Ordinance (Cap 221) s 14. The Secretary of Justice is the primary officer in respect of the prosecution of summary offences: Magistrates Ordinance (Cap 227) s 12.
