A rule which provides that in giving a power of appointment to another by will to select beneficiaries to receive a specific item of estate property, the testator must not delegate his or her testamentary or will-making power: Chichester Diocesan Fund v Simpson [1944] AC 341, 2 All ER 60 (HL). Accordingly, if a testator signs a document prepared by another person without knowledge of its contents, or a document which includes a phrase or even a word inserted by another of which he has no knowledge (Ng Chi-fong v Hui Ho Pui-fun [1987] HKLR 462), then either the document is not a valid will, or the phrase or word forms no part of an otherwise valid will, as the case may be. A condition which in effect delegates to another a testator’s testamentary power is void: Re Neave, Neave v Neave [1938] Ch 793, [1938] 3 All ER 220.
