释义	卸棄 To deny a claim or to renounce a right or interest in property. In bankruptcy law, the trustee in bankruptcy may disclaim certain onerous property of the bankruptcy vested in him and which is divisible amongst creditors in order to free himself and the estate from the burden and liabilities attached to the property. A trustee in bankruptcy may disclaim any lease which is part of his bankrupt’s property: Bankruptcy Ordinance (Cap 6) s 59. A disclaimer by a trustee in bankruptcy operates so as to determine, as from the date of the disclaimer, the bankrupt’s rights, interests and liabilities and his estate in or in respect of the property disclaimed, and discharges the trustees from all personal liability in respect of that property as from the date of the commencement of his trusteeship, but does not, except so far as is necessary for the purpose of releasing the bankrupt, the bankrupt’s estate and the trustee from any liability, affect the rights or liabilities of any other person: s 59(2). 否決申索或放棄財產的權利或權益。在破產法下，破產案受託人可卸棄若干歸予他／她的負有繁苛條件的財產，而該等財產可予分配各債權人，以解除他／她自己及有關產業附連在有關財產的的債務及法律責任。破產案受託人亦可卸棄任何作為破產人財產一部分的租契：《破產條例》（第6章）第59條。此等卸棄將破產人及其財產在遭卸棄財產中或就遭卸棄財產而享有的權利與權益和承擔的法律責任，自卸棄日期起予以終結，並將受託人就遭卸棄財產而承擔的所有個人法律責任，自遭卸棄財產歸屬受託人當日起予以解除，但除為解除破產人及其財產及受託人的任何法律責任而有需要者外，該項卸棄並不影響任何其他人的權利或法律責任：第59(2)條。v.
