| 释义 | 仲裁員顧問 Where reference in an arbitration agreement is made to two or more arbitrators, an arbitrator at any time after the appointment therein may appoint an umpire unless a contrary agreement has been made between the parties. Every arbitration agreement is deemed to include a provision that if the arbitrators have delivered to the parties or to the umpire a written note stating that they cannot agree, then the umpire may forthwith appear on the reference: Arbitration Ordinance (Cap 341) s 10(2). At any time after the appointment of the umpire, however appointed, and on the application of any party to the reference and notwithstanding anything to the contrary in the agreement, the High Court may order the umpire to enter the reference as if he were the sole arbitrator: sch 4 para 4.
