释义 | 集體訴訟 Legal proceedings which allow the claims of many individuals against the same defendant, which arise out of the same or similar circumstances, to be conducted by a single representative: Carnie v Esanda Finance Corp Ltd (1995) 182 CLR 398. There are several situations in which group or class actions would be highly beneficial to litigants. They include: multi-plaintiff consumer claims in respect of defective goods or services (Davies v Eli Lilly & Co [1987] 1 All ER 801, 1 WLR 1136 (CA)); multiple claims for damages (Chapman v CC of South Yorkshire (Times, 20 March 1990, unreported)); many persons seeking compensation for loss caused as a result of environmental damage or pollution.
