| 释义 | 法定售產信託 A trust constituted by a court order for the sale of land on the death of a person intestate, that is, any property included in the intestate estate is held by the personal representatives: (1) as to immovable property upon trust to sell; and (2) as to movable property upon trust to call in, sell and convert into money those parts which do not consist of money: Probate and Administration Ordinance (Cap 10) s 62(1); Fong Yee, Marie v Fong Yee, Violet [1997] HKLRD 228. Where a person died before 7 October 1971, there was no statutory trust for sale, but the administrator had power to dispose of the deceased’s estate at common law: Lo Fook Cheung v Law Yun Yau [1981] HKC 429. The terms of an express trust for sale, if there is one, override any statutory trusts for sale in any event: Re McKee, Public Trustee v McKee [1931] 2 Ch 145 (CA).
