| 释义 | 訊問／預審 The process of asking questions. At common law, the police’s power to question a suspect is subject to the suspect’s right to silence: Rice v Connolly [1966] 1 All ER 649, 3 WLR 17 (DC). In Hong Kong, the power of the police or other law enforcement agencies to question a suspect in custody is governed by the Secretary for Security’s Rules and Directions for the Questioning of Suspects and the Taking of Statements 1992. As soon as a law enforcement officer has evidence which would afford reasonable grounds for suspecting that a person has committed an offence, he shall caution the suspect before putting any question or any further question to him: Rules and Directions for the Questioning of Suspects and the Taking of Statements 1992; S-J v Lam Tat Ming & Anor [2000] 2 HKC 693, 2 HKLRD 431 (CFA). A person in custody is entitled to have a solicitor or barrister present to advise him during interrogation by any law enforcement officer: Rules and Directions for the Questioning of Suspects and the Taking of Statements 1992. When a suspect is questioned, accurate contemporaneous records must be kept of each interview: Rules and Directions for the Questioning of Suspects and the Taking of Statements 1992. The manner in which an interrogation is conducted may have a bearing on the admissibility of evidence obtained during it: S-J v Lam Tat Ming & Anor, supra.
