In criminal law, an accused’s answer to a charge when it is read to him or her in court, or the formal answer to the arraignment: Halsbury’s Laws of Hong Kong, Vol 9, Criminal Law and Procedure [130.738]. The plea must be public: R v Central Criminal Court, ex p Guney [1994] 2 All ER 423, 1 WLR 438. It usually takes the form of the answer ‘guilty’ or ‘not guilty’, which is known as a plea to the general issue. The accused may also make a special plea either in addition to or instead of the general plea: Halsbury’s Laws of Hong Kong, Vol 9, Criminal Law and Procedure [130.749]. The accused may be permitted to change the plea during the course of the hearing: S-J v Yuen Lit Ping [1999] 1 HKC 476. See also Arraignment; Change of plea; Indictment; Special plea.
