释义 | 對控罪的回答 In criminal law, negotiations between the prosecution and the defence by which the accused agrees to plead guilty to an offence on condition that the prosecution will not proceed with a more serious charge. Plea bargaining forms no part of the sentencing jurisprudence of Hong Kong: R v Scales, Peter Oswald [1987] HKLR 583 (CA). It is improper to seek, and unwise for a judge to give, any indication as to likely sentence before the accused is arraigned: R v Yeung Kuen Chi [1985] 2 HKC 163 (CA). The rationale for this is based on a concern that if the accused is aware of any indication by the judge, he might be improperly influenced in his decision to enter a plea of guilty: R v Atkinson [1978] 2 All ER 460, 67 Cr App Rep 200 (CA).
