| 释义 | 時間的共有 One of the ‘four unities’, which are the indicia of a joint tenancy. Joint tenants must acquire their interests at the same time. However, at common law the unity of title and time could be different where a gift to the co-owners was contingent, and it would vest at different times, ie land granted to A for life with remainder to the heirs of B and C. The requirement does not satisfy where B and C die at different times, thus their heirs would be vested in interest at different times. Exceptionally, unity of time is not required in the case of gifts by will or grant made behind a trust; but otherwise its absence means that any jointly-held property is held as a tenancy in common.
