释义 | 願意 Lat. A person who is willing or gives consent and thus undertakes a risk resulting in injury or damage. However, if a man is not of sound mind, he is not truly volens: Kirkham v Chief Constable of the Greater Manchester Police [1990] 2 QB 283 (CA). If the defendant was in breach of a specific duty imposed by law to guard against that very act, the defendant is not entitled to rely on the defence of volenti non fit injuria: Reeves v Cmr of Police of the Metropolis [2000] 1 AC 360 (HL).
