The law dealing with all of the activities and affairs in relation to the sea and navigable waters, including navigation, ships, sailors, carriage of passengers and property by sea, and other general marine affairs. It is greatly influenced by international customs and practices. For example, the use of bills of lading in international trade, and charterparties in ship chartering. The international customs and practices of seamen, such as the navigation rules, shape and colour of lights exhibited by ships, were developed into the International Regulations for Preventing Collisions at Sea 1972 (the ‘Collision Regulations’). Apart from customs and practices, Maritime law consists of (a) domestic law and statutes, such as Shipping and Port Control Ordinance (Cap 313), and Pilotage Ordinance (Cap 84); and (b) international conventions, which are implemented by local statutes. For example, the Collision Regulations are enacted by the Merchant Shipping (Safety) (Signals of Distress and Prevention of Collisions) Regulations (Cap 369N).
