| 释义 | 法定聲明 A declaration made in writing for purpose of allowing a person to ‘swear’ as to something, otherwise than through the taking of an oath or the making of an affidavit. In Hong Kong, the declaration must be made under the repealed Statutory Declarations Ordinance or the Oaths and Declarations Ordinance (Cap 11), and in the required form as prescribed by the Oaths and Declarations Ordinance [(Cap 11) sch 1. If it is made in any other common law jurisdictions, it means a declaration made before a justice of the peace, notary public, or other person having authority therein under any legal provision for the time being in force in the jurisdiction to take or receive a declaration. If it is made in the mainland of the People’s Republic of China, it means a declaration made before a notary pursuant to his notarial functions; if in any other place, it means a declaration made before a consul of the People’s Republic of China or a person having authority under a statute for the time being in force in the place to take or receive a declaration: Interpretation of General Clauses Ordinance (Cap 1) s 3. For example, for the purposes of any proceedings before the Registrar of Trade Marks, a statutory declaration or affidavit should be made in accordance with the rules: Trade Marks Rules (Cap 559A) s 80. It is an offence to knowingly and wilfully make, otherwise than on oath, a statutory declaration false in a material particular: Crimes Ordinance (Cap 200) s 36. 為准予一人就若干事情「宣誓」以作出的書面聲明，而非經宣誓或憑藉誓章。在香港，有關的聲明必須根據已被廢除的《法定聲明條例》或現行的《宣誓及聲明條例》（第11章），並憑藉《宣誓及聲明條例》（第11章）符表 1訂明的所需表格作出。如在其他普通法適用的地區作出，指在該地區的太平紳士、公證人或其他根據該地區當其時施行的法律條文而有權在該地區監理或接受聲明的人面前作出的聲明。如在中華人民共和國大陸作出，指在公證人依據其公證職能的情況下，在該公證人面前作出的聲明；如在任何其他地方作出，指在中華人民共和國領事或在該地方根據當其時施行的法規而有權監理或接受聲明的人面前作出的聲明：《釋義及通則條例》（第1章）第3條。例如就任何在商標處長席前進行的法律程序而言，任何法定聲明或誓章須根據有關規則作出：《商標規則》（第559A章）第80條。任何人明知而故意在非經宣誓的情況下，作出在要項上屬虛假的陳述，即屬犯罪：《刑事罪行條例》 （第200章）第 36條。 |
