释义 | 相片辨認 The pre-trial identification of an accused from photographs. Photo identification may involve a procedure by which someone who has seen a suspected offender is shown photographs of persons known to others, usually the police, and by recognising one of them as a suspected offender, makes an identification. A photo identification is admissible into a trial as evidence but a trial judge’s discretion may be used to exclude any evidence if it is unfair: R v Varley (1910) 10 Cr App R 125. The prejudice which might have resulted is that the identification will be conducted in the absence of the accused who will then be deprived of the opportunity to challenge the fairness and irregularities of the identification process.
