| 释义 | 限制令 A court order preventing a party from doing something. Criminal law - In relation to bribery and corruption, an enforceable direction by a court that a suspected person be prevented from dealing with all, or some, of his or her property except as provided by the court where that property was derived from unlawful activity. It includes any property in the possession of or under the control of or due to a suspected person from a third party, or being held for or on behalf of or to the order of a suspected person by a third party: Prevention of Bribery Ordinance (Cap 201) s 14C(1). The restraining order will also apply, if so ordered, to any income from the property specified in the order: s 14C(2A). The court has an inherent jurisdiction to revoke an ex parte restraining order that has been made under a fundamental misapprehension of law or fact, including insufficiency of evidence: Yee Po Land Development Co Ltd v ICAC [1977-1979] 1 HKC 340. An order restraining any person from attempting to defeat a claim for financial provision or otherwise for protecting the claim: Matrimonial Proceedings and Property Ordinance (Cap 192) s 17(1)(a). In deciding whether a restraining order should be granted, the court would take into consideration, among other factors, whether there will be any irreparable harm on the other party: Chen Lee Hong Man v Chen William [1981] 1 HKC 481 (HC). 2. An order restraining the husband from selling or otherwise disposing of the matrimonial home without the wife’s consent or providing her alternative accommodation: Married Persons Status Ordinance (Cap 182) s 7; Chan Tsoi Wai-loi v Chan Kwok Fai [1980] HKLR 406. 3. An injunction containing a provision in whatever terms (1) restraining the other party to the marriage from using violence against the applicant or a child living with the applicant; or (2) excluding the other party from the matrimonial home, or from a specified part of the matrimonial home or from a specified area, the judge, if he is satisfied that the other party has caused actual bodily harm to the applicant or, as the case may be, to the child concerned, may attach a power of arrest to the injunction in the prescribed form: Domestic Violence Ordinance (Cap 189) ss 5(1), 6(3).
