释义	復原賠償 Damages requiring the defendant to pay for the benefit obtained from the plaintiff’s partial performance of the contract. Restitution damages are available where the plaintiff has conferred benefits on the defendant but is unable to claim the contract price on breach: A-G v Blake (Jonathan Cape) [1998] 1 All ER 833, [1998] 2 WLR 805 (CA). An example of restitution damages is where a buyer of goods pays the price in advance of delivery, but the seller does not deliver, or does not have title; the buyer is entitled to recover as damages a sum equal to the amount paid. The object of an award of the damages is for protecting the plaintiff’s restitutionary interest and is not for compensating any loss but to deprive the breaching party of the benefit gained (Chan Yock Kwong v Wong Hee Mao [1962] HKLR 480) by the breach of contract: Surrey County Countil v Bredero Homes Ltd [1993] 3 All ER 705, 1 WLR 1361 (CA).
