释义 | 官方機密 Information of a public nature which if disclosed would prejudice the national security or cause substantial or irreparable harm to the People’s Republic of China or Hong Kong. The Official Secrets Ordinance (Cap 521) creates a series of offences in respect of official secrets and espionage and makes provision for enforcement and investigation of such offences. Official secrets include security and intelligence information, defence information, information related to international relations, information related to the commission of offences and criminal investigations, information resulting from unauthorised disclosures or information entrusted in confidence, information resulting from spying, information entrusted in confidence to territories, states or international organisations: Official Secrets Ordinance (Cap 521) ss 15-20. It is an offence to make a damaging disclosure of official secrets without lawful authority: ss 15-20. The information may have been entrusted to member of the security and intelligence services, public servant or government contractor or it may have been obtained owing to a person’s position in relation to the People’s Republic of China or Hong Kong: ss 15-20.
