Lat – let the principal answer. A maxim providing that where a relationship of employer and employee exists, an employer is responsible and liable in certain cases for the wrongful acts or omissions of his or her employee although the employer is without fault or blame. The doctrine respondeat superior embodies the doctrine of vicarious liability and has the same effect as the maxim qui facit per alium facit per se. The maxim applies to render an employer vicariously liable only in respect of the torts of his or her servant, and not torts committed by independent contractors except in special circumstances: Shek Kam Ching v Po Kee Construction Engineering Ltd [2002] 3 HKLRD 795. In addition, the maxim requires the wrongful act or omission, whether specifically authorised or not, to have taken place within the legitimate scope of the employee’s employment: Morgans v Launchbury [1973] AC 127. At common law, an employer is not criminally liable for the acts of his or her employee unless the acts were authorised or aided by him or her: Jiang Enzhu v Lau Wai Hing, Emily [1999] 3 HKC 8, [2000] 1 HKLRD 121.
