释义 | 後裔 A descendant is generally construed as meaning anyone who is descended from a particular individual, however that descent is traced. Accordingly, a ‘male descendant’ would include all such descendants including those who have their descent through a female: Re Drake’s Will Trusts, Drake v Drake [1970] 3 All ER 32, [1971] Ch 179. It will not include collateral relations unless there is a clear definition clause in the will to that effect: Re Thurlow (dec’d), Riddick v Kennard [1972] Ch 379, 1 All ER 10; Mellows, The Law of Succession (5th Ed, Butterworths) pp 156-157.
