释义 | 貨幣 1. Money in circulation in an economy by which sales and purchases are effected. Hong Kong’s monetary unit (or unit of currency) is the Hong Kong dollar. After the resumption of sovereignty over Hong Kong by China, Hong Kong legal tender banknotes and coins continue to circulate but any such banknotes or coins bearing references inappropriate to the status of Hong Kong as a Special Administrative Region of the People’s Republic of China is being progressively replaced and withdrawn from circulation. The authority to issue Hong Kong currency is vested in the Government of the Hong Kong SAR, which may authorise designated banks (note-issuing banks) to issue or continue to issue Hong Kong currency under statutory authority. The issue of Hong Kong banknotes must be backed by a 100% reserve fund: Basic Law art 111. The designated note-issuing banks are now the Bank of China, the Standard Chartered Bank and the Hongkong and Shanghai Banking Corporation Limited: Legal Tender Notes Issue Ordinance (Cap 65) sch. 2. Coin and paper money designated as legal tender. Legal tender notes are defined to mean currency notes issued in Hong Kong by the Financial Secretary and banknotes issued in Hong Kong by a note-issuing bank in accordance with the terms and conditions to which its authorisation is subject: Legal Tender Notes Issue Ordinance (Cap 65) s 2. All legal tender notes shall be legal tender in Hong Kong to any amount: s 4. In particular, every such note shall be deemed to be a currency of Hong Kong for the purpose of any promise to pay printed on it: s 4. The Chief Executive in Council may by order authorise the issue of coins which shall be legal tender for payment. Each coin shall be legal tender only for the amount of its denomination: Coinage Ordinance (Cap 454) s 2. Unless the contrary appears, there is a presumption that the determination in what currency a debt is to be paid is governed by the lex loci solutionis (law of the country where the performance is to take place): Adelaide Electric Supply Co v Prudential Assurance Co [1934] AC 122. The lex monetae (law of the country of the currency) defines the meaning of the currency and what constitutes legal tender for that country. A plaintiff suing in a Hong Kong court for a debt governed by the law of another jurisdiction, may make that claim in Hong Kong dollars or in the currency of the contract. 3. The currency of a bill of exchange refers to the period for which it is drawn or the period which it has to run before maturity. The currency of a bill of exchange payable after sight will begin to run once it is accepted.
