Fr – superior strength clause A kind of escape or let-out clause and is often called hardship clause. The inclusion of such clause is very common in commercial contracts in particular where the parties foresee such problems are likely to happen but are uncertain as to their nature and extent. The inclusion of such clause excludes a party from liability caused by unexpected or uncontrolled event of natural in nature. A party cannot rely upon a force majeure clause if he or she knew at the time the contract was made the clause would inevitably come into operation: Cargill Hong Kong Ltd v Hoecheong Products Co Ltd [1993] HKLY 187 (CA).
