释义 | 嚴重損傷 1. A grave, severe, material, or important violation or infringement of another’s legal rights to his or her person, property or reputation. This type of injury may but does not necessarily lead to actual harm or damage. What amounts to a serious injury is a question of fact, to be determined from the particular circumstances of each case. 2. An injury which gives a disability which mars general activities and enjoyment of life but allows reasonable mobility to the victim, for example a loss of a limb replaced by a satisfactory artificial device or bad fractures leading recurrent pain: Lee Ting Lam v Leung Kam Ming [1980] HKLR 657. An injury which is sustained by a person in a reportable accident and which requires his stay in hospital for more than 48 hours commencing within seven days from the date on which the injury was received; or results in a fracture of any bone (save simple fractures of fingers, toes or nose); or involves lacerations which cause nerve, muscle or tendon damage or severe haemorrhage; or involves injury to any internal organ; or involves second or third degree burns or any burns affecting more than 5 per cent of the body surface: Hong Kong Civil Aviation (Investigation of Accidents) Regulations (Cap 448B) reg 2(1).
