| 释义 | 管養令 An order made by the court awarding custody of a child under 18 years of age to a person. The court’s jurisdiction is contained in the Separation and Maintenance Orders Ordinance (Cap 16) s 5(1)(b); Matrimonial Proceedings and Property Ordinance (Cap 192) ss 19(1), 20(1); Guardianship of Minors Ordinance (Cap 13) ss 10(1), 11(1)(a), 12(a). In making a custody order, the first and paramount consideration by the court is the welfare of the child. Other factors include the wishes of the child, the circumstances of the case, the conduct and wishes of the parents, desirability of siblings to stay together, maintaining the status quo, and material information like any report from the Director of Social Welfare. Custody may be awarded to either the husband or the wife, or to them jointly, or to the guardian. If there are exceptional circumstances, the court may make an order committing the care and supervision of the child to the Director of Social Welfare instead: Guardianship of Minors Ordinance (Cap 13) s 13(1)(a); Matrimonial Causes Ordinance (Cap 179) s 48A(1).
