The possession and the right to possession by two or more persons contemporaneously of an interest in the same whole parcel of land or chattels personal. Concurrent ownership of chattels personal and concurrent interests in real estate may be either joint or in common. Moreover, the expression ‘co-ownership’ contained in any instrument which, at common law, would create a joint tenancy or tenancy in common in realty have an analogous effect when applied to personalty: Halsbury’s Laws of Hong Kong, Vol 20, Personal Property [295.043]. Co-ownership may exist at law or in equity, and co-owners may be joint tenants or tenants in common, for joint tenancy: Liu Kwok Wah v Chung Hang Fai Nancy [1989] 2 HKC 259; or for tenancy in common: Chow Doi Kwai v Chan Cho Yuk [2000] 2 HKLRD 235. Apart from joint tenancy and tenancy in common, co-ownership may also take forms such as strata title, stratum title, cluster title, and a timeshare. Co-ownership may also involve the presence of one or more of the four unities; namely, a unity of time, title, possession and interest.
