| 释义 | 有關品質或適用性的隱含責任承擔 An implied condition that when a seller sells goods under a contract in the course of a business, the goods supplied are of merchantable quality, meaning that the goods are (a) fit for the purposes for which they are commonly bought; (b) of such standard of appearance and finish; (c) free from defect; (d) safe; and (e) durable; as can be reasonably expected from their description and price. There is no such implied condition as regards those defects, however, if prior to the contracting, (a) they have been brought to the attention of the buyer; (b) the buyer has examined the goods and ought to have discovered them; or (c) in the event of sale by sample, they would have been apparent on a reasonable examination of the sample: Sale of Goods Ordinance (Cap 26) ss 2(5), 16(2). Further, if the buyer makes known to the seller any particular purpose for buying the goods, there is an implied condition that the goods supplied are reasonably fit for that purpose, except that the buyer does not or cannot reasonably rely on the seller’s skill or judgment: s 16(3). An implied condition or warranty as to quality or fitness for a particular purpose may be annexed to a contract of sale by usage: s 16(4). In general, except as provided by the Sale of Goods Ordinance (Cap 26) ss 16, 17(sale by sample), and subject to any other statutory provision (for example, Consumer Goods Safety Ordinance (Cap 456)), there is no implied condition or warranty as to the quality or fitness for any particular purpose of goods supplied under a contract of sale: s 16(8).
