Circumstantial evidence |
Evidence of a fact or facts from which another fact or series of facts relevant to the case might be inferred or deduced. There is no rule of law that such evidence is to be treated differently from other evidence. Accordingly the judge is not under any duty to direct the jury on the significance of circumstantial evidence as distinct from direct evidence: R v Wong Mau Ting [1967] HKLR 531. Where circumstantial evidence is relied upon, the jury should be simply directed to be satisfied beyond reasonable doubt: McGreevy v DPP [1973] 1 All ER 503, 1 WLR 276 (HL); R v Sze Sing Ming [1991] 2 HKLR 481. See also Direction to jury; Evidence. 另見 Direction to jury; Evidence。 |
