释义 | 尚存父母 The living father or mother of a child when the other parent has passed away. On the death of a parent of a minor, the surviving parent becomes the minor’s guardian either alone or jointly with any guardian appointed by the deceased parent; and where no guardian has been appointed by the deceased parent, or in the event of the death or refusal to act of the guardian or guardians appointed by the deceased parent, the court may, if it thinks fit, appoint a guardian to act jointly with the surviving parent: Guardianship of Minors Ordinance (Cap 13) s 5.
