| 释义 | 連續信託 1.A trust which is not terminated by a specified time period or upon the occurrence of some event. 2. A trustee or personal representative has, in addition to the powers and discretion contained in the trust document, certain statutory powers: Probate and Administration Ordinance (Cap 10) ss 53-60, 68-71. The terms ‘trustee’ and ‘personal representative’ are synonymous: Trustee Ordinance (Cap 29) s 2. In general terms, they are obliged to act prudently and properly in the management of the estate as a whole and the courts will generally not interfere with the exercise of their discretion: Re Charteris, Charteris v Biddulph [1917] 2 Ch 379 (CA); Re Whichelow, Bradshaw v Orpen [1953] 2 All ER 1558, [1954] 1 WLR 5. These powers may so extend to situations in which the particular beneficiaries may indicate their unanimity that their wishes be complied with: Proud v Jansserts [1964] HKLR 863. Hence, the beneficiaries are not in a position to dictate the vesting of the entire trust property if its effect is to extinguish the trust. That means, a continuing trust must not offend against the rule against perpetuities.
