| 释义 | 釐定價格／操縱價格 To set or stabilise or control the price of a commodity or product at a particular level by way of effort or arrangement or agreement. Manufacturers often specify or agree with retailers the lowest price at which a product could be sold to customers, this often termed as vertical price fixing. Fixing price of certain commodities or products may be regarded as a kind of manipulation thus an illegal act. In Hong Kong, controlling stock price in any form (also referred to as ‘rigging prices’) which includes fixing price is a form of market misconduct: Securities and Futures Ordinance (Cap 571) s 245. Restriction on fixing prices for securities is provided for in the Securities and Futures Ordinance (Cap 571) s 275. Price rigging can constitute an offence and amount to civil liability: ss 296, 305. Fixing a price of a property may be in the nature of an arbitration: Mayers v Dlugash [1994] 1 HKC 755 (HC).
