| 释义 | 難民身分覆檢委員會 The Board established under Immigration Ordinance (Cap 115) s 13G which reviews the decision of the Director of Immigration that a Vietnamese person may not remain in Hong Kong as a refugee, pending his resettlement elsewhere. Any resident or former resident of Vietnam who arrives in Hong Kong not holding a travel document which bears an unexpired visa issued by or on behalf of the Director, and has not been granted an exemption, may, whether or not he has requested permission to remain in Hong Kong, be detained pending a decision to grant or refuse him permission to remain in Hong Kong: Immigration Ordinance (Cap 115) s 13D(1). Where a person is detained after a decision refusing him permission to remain in Hong Kong, the detained person will be served a notice notifying him of his right to apply for a review to the Board: ss 13D(3). A person on whom such a notice is served may, within 28 days of such service, apply to the Board to have the decision reviewed: s 13F(1). Representative by a prescribed person (an appeals counsellor engaged by the Agency for Volunteer Service), or a legal representative, is allowed: Immigration (Refugee Status Review Boards) (Procedure) Regulations (Cap 115L) reg 6. The Board shall sit in private (reg 8) and may if it thinks fit require the applicant in person, or an immigration officer, to appear before it for the purpose of answering such questions as the Board may think fit, being questions arising on the papers before it: reg 10(1).
