| 释义 | 法律兼事實問題 A question involving a combination of issues of fact and issues of law. For example, whether an accused person was insane at the time of committing the criminal act is ordinarily a question of mixed fact and law. It is for the jury to decide the factual question of whether the accused was insane at the time of committing the criminal act. However, the judge must decide the legal question of whether the defence raised is one of insanity: R v Dickie [1984] 3 All ER 173.
