A hearing in which the issues of fact or law, or both, between the parties are fought out to a final conclusion binding upon the parties. There must be an investigation of the merits of the matter. There is no hearing on the merits where the proceedings have come to a halt because the defendant has pleaded guilty (Ellis v Burton [1975] 1 All ER 395, 1 WLR 386), a withdrawal of proceedings, want of jurisdiction, a failure to comply with some procedural step, or a defect in the information or charge. There is a hearing on the merits where a plea of autrefois acquit has been sustained, for an acquittal by direction, or the offering of no evidence on the hearing of the charge. 爭議各方就事實的爭論點或法律的爭論點或兩者的爭論點進行耹訊,直至產生對雙方具約束力的定論為止。須就有關案件的的是非曲直作出調查。如有關的法律程序因下述的情況而終止,則法庭無需就案情的是非曲直進行聆訊:被告人已作出認罪的答辯;法律程序被撤回;無司法管轄權;沒有遵守若干程序上的步驟;或在告發或控告書上有缺失(Ellis v Burton [1975] 1 All ER 395, 1 WLR 386)。但如已證明曾就同一罪行獲裁定無罪;經指示獲判無罪釋放;或就控告作出聆訊時沒有提供證據,則法庭須就案情的是非曲直進行聆訊。另見 Autrefois acquit; Directed verdict; On the merits。
