| 释义 | 隨後發生的事情 1. An event extraneous or additional to something else preceding it. A supervening event may constitute a new intervening event (novus actus interveniens) which severs the causal link between a defendant’s negligence and the plaintiff’s injury. The supervening event then becomes the effective cause of the plaintiff’s injury: Cheung Hei Kwong v Kwong Key Construction & Engineering Ltd (HCPI 1260/99, unreported); Kwok Sui Shum Dorothy v Hui Lam Ho (HCPI 375/2001, unreported). Where the supervening event is a tortious act, it does not reduce the measure of damages for which the initial defendant is liable: Baker v Willoughby [1970] AC 467. 2. Supervening events, such as illegality, may suspend the obligation to perform a contractual promise without altogether discharging it: Cricklewood Property and Investment Trust Ltd v Leightons Investment Trust Ltd [1945] AC 221, 1 All ER 252 (HL).
